Interpretation and Definitions

Interpretation:
The terms in this agreement are capitalized and defined based on the following meanings. These terms apply in singular and plural forms equally.

Definitions:

  • Affiliate: An entity that is controlled by, controls, or is under common control with another entity, defined as owning 50% or more of the shares or equity interest entitled to vote for election of directors or other managing authority.
  • Account: A unique account created to access our Service or parts of our Service.
  • Country: Refers to Australia.

  • Device: Any device (computer, mobile phone, tablet) that can access the Service.
  • Feedback: Suggestions, feedback, or ideas provided by you related to the Service.

  • Orders: A request to purchase Goods from Us.

Acknowledgment

By accessing or using the Service, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, you must refrain from using the Service.

  • You represent that you are over the age of 18. The Company does not permit use of the Service by individuals under 18 years of age.
  • Your use of the Service is also governed by the Company’s Privacy Policy. Please review the Privacy Policy for details on how we collect, use, and protect your personal information.

Placing Orders for Goods

By placing an Order for Goods through the Service, you confirm that you are legally capable of entering into binding contracts.

Your Information:
When placing an Order, you may be required to provide personal information, including but not limited to your name, email, phone number, payment information (credit card details), billing address, and shipping information. You represent and warrant that this information is accurate, complete, and lawful to use.

Order Cancellation

The Company reserves the right to refuse or cancel an Order at any time for reasons including, but not limited to:

  • Availability of Goods
  • Errors in product descriptions, pricing, or your Order
  • Suspected fraud or unauthorized transactions

Cancellation Rights:
You can cancel your Order in accordance with these Terms and the Company’s Returns Policy. Returns are allowed only if Goods are in their original, unused condition. Goods that are damaged, opened, or worn beyond inspection will not be refunded.

We will process your refund no later than 7 days from receiving the returned Goods. Refunds will be made using the original payment method.

Non-returnable Goods:
You may not cancel Orders for:

  • Custom-made or personalized Goods
  • Goods that deteriorate quickly (e.g., perishables, certain electronics)
  • Goods that were unsealed after delivery for health and hygiene reasons

Damages

The Company is not responsible for any damage caused to the device or individual due to improper use of the Goods. Our warranty program covers only manufacturing defects, not damages caused by misuse.

Availability, Errors, and Inaccuracies

We continually update our product listings and prices, but information on the Service may sometimes be incorrect or outdated. We cannot guarantee the accuracy, completeness, or availability of Goods. We reserve the right to correct errors or omissions, including product descriptions and prices, at any time without prior notice.

Price Policy

The Company reserves the right to modify product prices before accepting an Order. Prices may change after an Order is accepted if circumstances beyond the Company’s control arise (e.g., shipping delays, government actions, or currency fluctuations). In such cases, you have the option to cancel the Order.

Payments

All purchases are subject to one-time payment. Payments are processed via secure methods, such as credit cards (Visa, MasterCard, American Express, etc.) or online payment methods (e.g., PayPal). Payment is subject to validation checks and authorization by your payment provider.

The Company is not responsible for delays or non-delivery of your Order if authorization is not received.

User Accounts

To create an Account, you must provide accurate, complete, and up-to-date information. Failure to do so may result in the suspension or termination of your account. You are responsible for safeguarding your account password and must notify us immediately if you suspect any security breaches or unauthorized use of your account.

You may not use offensive, inappropriate, or trademarked names for your username.

Intellectual Property

The Service, including its content, features, and functionality, is owned by the Company and its licensors. All content is protected by copyright, trademark, and other intellectual property laws. Unauthorized use of our trademarks or content is prohibited without prior written consent from the Company.

Feedback:

By submitting feedback, you assign all rights to the Company or grant the Company a perpetual, irrevocable, royalty-free license to use, modify, and distribute your feedback as it deems necessary.

Links to Third-party Websites

The Service may contain links to third-party websites or services. The Company is not responsible for the content, privacy policies, or practices of these third-party websites. You are advised to read their terms and privacy policies before engaging with such sites.

Termination

The Company reserves the right to suspend or terminate your Account without notice if you breach these Terms. Upon termination, your right to use the Service immediately ceases.

Limitation of Liability

To the maximum extent permitted by law, the Company’s total liability is limited to the amount you paid for the Goods, or 100 CAD if no purchase was made. The Company is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

“As Is” and “As Available” Disclaimer

The Service is provided “AS IS” and “AS AVAILABLE,” with no warranties or guarantees. The Company does not guarantee that the Service will meet your requirements or that it will be free from interruptions, errors, or viruses.

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Dispute Resolution

In case of any dispute, you agree to first attempt to resolve it informally by contacting the Company.

Severability and Waiver

If any provision of these Terms is found to be unenforceable, it will be modified to reflect the intent of the provision as closely as possible, while the remaining provisions will remain in full force and effect. A waiver of any breach of these Terms does not waive future breaches.

For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Changes to These Terms

The Company reserves the right to modify these Terms at any time. If changes are significant, we will notify users at least 30 days before the revised Terms come into effect.
